Terms of Service

FiddleDawdle (the “Service”) is operated by Waters Technology Group (“we”, “us”, “our”). By creating an account, browsing, buying, or selling on FiddleDawdle, you agree to these Terms of Service. If you do not agree, do not use the Service.

1. Who can use FiddleDawdle

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By using the Service you confirm that the information you provide is accurate and that you are legally able to enter into this agreement.

2. Accounts

You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used unlawfully.

3. Buying music and memberships

When you purchase a track, you receive a personal, non-transferable license to download and listen to that recording for your own private use. You do not acquire ownership of the underlying rights, and you may not redistribute, resell, publicly perform, or commercially exploit any purchase. Artist memberships grant streaming access to members-only content for as long as the membership is active.

4. Selling as an artist or label

If you upload and sell content, you represent that you own or control all rights necessary to do so, and that your content does not infringe anyone else’s rights. You grant us the limited license needed to host, stream, display, and deliver your content to buyers through the Service. You set your prices; FiddleDawdle retains a flat platform fee (currently 15%) per sale, and the remainder is paid out to you (and, for label signings, split with the artist on the terms you agree). Payouts are made through Stripe and require a connected Stripe account in good standing.

5. Payments and taxes

Payments are processed by Stripe, Inc., subject to Stripe’s own terms. Prices are shown exclusive of tax where applicable; sales tax is calculated and added at checkout based on your location and the type of product. You are responsible for any taxes on income you earn as a seller.

6. Prohibited conduct

You agree not to: upload content you don’t have the rights to; attempt to circumvent payment, licensing, or download protections; scrape, resell, or redistribute content; abuse, harass, or defraud other users; or interfere with the security or operation of the Service.

7. Intellectual property

The FiddleDawdle name, logo, and platform are our property. Artists and labels retain ownership of the music they upload. We will respond to valid intellectual-property complaints and may remove infringing content and terminate repeat infringers.

8. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Waters Technology Group is not liable for indirect, incidental, or consequential damages, and our total liability arising from the Service is limited to the amount you paid us in the twelve months before the claim.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continuing to use the Service after changes take effect means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules.
